Terms and Conditions
Terminology
v In the following
text the term “We” and/or “Kustom Komputa” refers to Kustom Komputa.
v The term “you”
refers to the Kustom Komputa customer; in a prospective and/or actual
role with regard to purchasing of products from Kustom Komputa.
v The term “this
site” refers to the site “Kustom Komputa” and its content pages upon
which these Terms and Conditions are relevant.
v The term
“British Law” or “Law of England” refers to the current Laws of the United Kingdom other than
where the Law varies within the provinces of the United Kingdom, in which case
the Law of the country of England within the United Kingdom is relevant and
is governance of this site.
v The terms
“product(s)” and “goods” relate to any items offered by and/or purchased
from Kustom Komputa, received or not received as stated accordingly,
unless otherwise stated.
v The term “user”
refers to anyone operating or owning or handling or transporting the
computer(s) or computer component(s) supplied by Kustom Komputa following
receipt of said item(s) at the delivery address.
Purchase
v When purchasing
products from this site, you undertake where appropriate to provide a
descriptive or specification or if possible technical specification, of
the goods you require by means of the Quotation Request form, in order
that Kustom Komputa can agree with you on the design specification and
negotiate where necessary – Or at least give some indication of your
requirements in order that Kustom Komputa can suggest a Kustomised design
brief to you for the purpose of negotiation with a view to receiving the
go-ahead to build and supply said design.
v Also when
purchasing and also when happy with the agreed build specifications and
in agreement of these, having received a free price quotation from Kustom
Komputa and having given the go-ahead for the build with total
satisfaction, you agree to pay said price quoted for your individualised
computer(s) and/or computer component(s) in lieu of construction and
delivery by paying in full the balance of the invoice generated by PayPal
and sent to your email address in line with the policies of PayPal.co.uk
. You understand that payment is only possible by means of PayPal, and
that other payment methods are not possible unless previously negotiated
between you and Kustom Komputa and agreed by Kustom Komputa. You agree
when actually making the purchase transaction when diverted to the PayPal
site by the relevant payment link, encrypted or otherwise, to abide by
the Terms and Conditions of PayPal.co.uk .
v You agree to be
bound by the above, and also the following, terms and conditions of sale;
which are in addition to your Statutory Rights as a Consumer under
British Law. You also agree to be bound by British Law and/or the relevant
Law of England when purchasing from Kustom Komputa and/or as regards any
disputes or actions of any other nature in connection with Kustom
Komputa.
v You understand
that post-sale and post-delivery returns can be made on the condition
that your Kustom Komputa product has internal material defects or defects
in workmanship upon arrival at the destination delivery address, and/or
in the case that your Kustom Komputa product differs vastly from the
product that you paid for and ordered. You also understand that you may
return goods to Kustom Komputa subject to British law as stated in the
second paragraph under “Returns” below.
v In the case of
your payment exceeding the requirements of your order we undertake to
refund any such overpayment except in the case of where it is clearly
stated to the contrary.
v In all cases an
invoice bearing the name ”Kustom Komputa”, will be sent to you by email,
following your agreement on the design and placement of your order and
the agreement of the specifications negotiated between you and Kustom
Komputa, also the agreement of the price of the product as set out in
your free quotation. You undertake to pay this invoice in full, in
abidance also with the PayPal Terms and Conditions along with any other
stated Terms and Conditions in the section of this site that you are
ordering from, in addition to those stated on this page.
Returns
v Kustom Komputa
undertakes to repair the supplied computer or to return monies paid for any
item in the unlikely event of it having material defects or defects in
workmanship upon its arrival at the delivery address. Kustom Komputa also
undertakes to return monies paid for any item which significantly differs
from the product which was ordered. Monies paid or repairs will be
refunded or undertaken upon return of product to Kustom Komputa at the
customer’s own expense. If the product is subsequently judged to have
proven material defect, defective workmanship, or to be significantly
different from the product ordered, then the price paid for the item
returned shall be fully reimbursed along with any reasonable costs to the
customer involved in returning the product by Kustom Komputa, or the
computer will be repaired/replaced and returned to the customer.

v Kustom Komputa
will not accept returns for the following reasons, or for problems caused
due to the following. :
A change of mind
about the purchase contract, damage caused by user negligence or user
error; software problems relating to third party software preinstalled by
Kustom Komputa, (Refer to Microsoft or the software vendor.) or otherwise
installed by user(s) following receipt of goods; minor external damage
caused by transit, for example such as a 1mm scratch, a tiny and hardly
noticeable dent in the casing, et-cetera. (Major damage caused in transit
should be claimed for against the courier, in association with and with
the backing of, Kustom Komputa.) Damage or problems due to upgrades not
carried out by Kustom Komputa; problems caused by malicious software,
viruses, Trojans, spyware,
freeware, badly-written or coded programs written by the user or otherwise;
damage caused by any other incorrect usage of the product supplied by
Kustom Komputa; damage by fire, other than fire caused by malfunctioning
hardware components within the Kustom computer itself which are still
covered by a warranty; damage caused to the machine by operating or
upgrading either the provided hardware or the provided software; damage
caused otherwise by malicious user interaction; war; civil insurrection;
terrorism; vandalism; Linux usage; electrocution; water damage, whether
caused by the users’ damp storage conditions, condensation, submersion,
spillage, or otherwise; earthquake; lightning; voltage spike; incorrect
supply voltage; tampering; or act of God.
v Under British
Law (Distance Selling Regulations 2000) you have a period of seven days
from receipt of goods in which to return said goods for any good reason.
Such good reasons do not include a change of mind about the contract of
purchase previously agreed between yourself and Kustom Komputa and
confirmed by your payment in lieu. On receipt of such returns, or within
a reasonable period from receipt of goods, Kustom Komputa will reimburse
you, by means of PayPal, with the cost of the goods minus the cost of the
original carriage to the delivery address by whatever means. Kustom Komputa
will only reimburse carriage costs in the case of a defect in workmanship
and/or a material defect having been proven to have been present upon
your initial receipt of the goods, or if the product received by you
differs significantly from the product that you ordered and/or agreed to
receive. If such defect should be proven; Kustom Komputa will reimburse
your original payment in full, plus the cost of return carriage incurred
by you up to a reasonable amount.
Correspondence
v Correspondence relating
to Terms and Conditions outside of these published Terms and Conditions
shall not be entered into.
